Use of these Sites is made at no charge (unless otherwise stated), although you should be aware that charges for Internet use may apply at rates determined by your provider. TSN reserves the right to change the products, services, prices, and programs mentioned in these Sites, at any time, at its sole discretion.
Further, your use of these Sites is subject to those additional terms and conditions provided by TSN and, subject to TSN’s sole discretion, applicable to certain information, products, and services offerings available through this Site. Such additional terms and conditions include, but are not limited to, Privacy Policy, Copyrights, Trademarks, Consent for Linking, Online Orders, Export Compliance, license agreements, and supplementary user agreements (collectively, “Additional Terms”). The Additional Terms are hereby incorporated by reference into these Terms (if there is any conflict between the Additional Terms and these Terms, the Additional Terms shall prevail with respect to the subject matter of such Additional Terms).
TSN reserves the right to change these Terms, and provide you with notice of such change by posting the revised draft of the Terms on these Sites or by other reasonable means selected by TSN. Your continued use of these Sites after such changes will indicate your acceptance of such changes.
TSN further reserves the right to seek all remedies available by law and in equity for any violation of these Terms. Any rights not expressly granted herein are reserved by TSN.
All materials on the TSN Sites are copyrighted and may not be used without the written permission of TSN except as provided in these Terms.
- All parties shall use the TSN Site for lawful purposes only. No party shall post or transmit through the TSN Site any material that violates or infringes in any way upon the rights of others, that is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable, that encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law, or that, without TSN’s express prior approval, contains advertising or any solicitation with respect to products or services.
- Any personal data (for example, name, address, telephone number, or e-mail address) transmitted to these Sites by electronic mail or otherwise, will be used by TSN in accordance with TSN’s Privacy Policy. Any other communication or material transmitted to these Sites, such as questions, comments, suggestions, or the like, will be treated as non-confidential and non-proprietary.
- Under no circumstances, including, but not limited to, negligence, shall TSN, its subsidiaries or affiliates be liable for any direct, indirect, incidental, special or consequential damages that result from the use of, or the inability to use, TSN materials, products, or services. You, as the user, specifically acknowledge and agree that TSN is not liable for any defamatory, offensive, or illegal conduct of any user. If you are dissatisfied with any TSN material, products, or services or with any of TSN’s Terms, your sole and exclusive remedy is to discontinue using TSN Sites, material, products, or services.
- Images of people, projects, or places displayed on these Sites are either the property of, or used with permission by, TSN. The use of these images by you, or anyone else authorized by you, is prohibited unless specifically permitted by these Terms and Conditions or specific permission provided elsewhere on these Sites. Any unauthorized use of the images may violate copyright laws, trademark laws, the laws of privacy and publicity, and communication regulations and statutes.
- The trademarks, logos, and service marks (collectively the “Trademarks”) displayed on these Sites are registered and unregistered Trademarks of TSN. Nothing contained on these Sites should be construed as granting, by implication or otherwise, any license or right to use any Trademark displayed on these Sites without the written permission of TSN. The use of the Trademarks displayed on these Sites, or any other content on these Sites, except as provided in these Terms and Conditions, is strictly prohibited. You are also advised that TSN will aggressively enforce its intellectual property rights to the fullest extent of the law, including criminal prosecution.
- Some of TSN’s sites contain links to other sites whose information practices may be different from TSN’s. You should consult the other site’s privacy notices, as TSN makes no warranties regarding the information that is submitted to, or collected by, these other sites.
- The information on this site is provided without warranty of any kind, expressed or implied, including that of fitness for a particular purpose. Privacy
Protection of personal privacy is a major concern of TSN. TSN maintains the anonymity of each responder unless that responder has expressed consent to release certain personal information or responses.
In the same way, TSN protects the identity of those who access its Sites. The following policy provides details as to the types of information collected through TSN web sites, including personal information and how it is treated.
- Information Collected by Web Site
TSN Web sites gather information in two ways: (1) indirectly (for example, through site technology), and (2) directly (for example, when the site visitor voluntarily provides information on various pages). - Information Collected Indirectly
TSN indirectly collects a variety of information pertaining to the use of its Sites. This information may include: your IP address, browser type, operating system, domain name, access times and referring web site addresses. This information is used for the general operation of the Sites, to maintain quality of the service, and to provide general statistics regarding use of our web sites.TSN also collects non-personal information about which pages our customers visit within our Sites. Other types of indirectly collected information are stored in “cookies.” Cookies are small files of electronic information that a web site can transfer to a visitor’s hard drive to help that visitor while on these Sites. Some TSN Sites use cookies simply to store a user code so that users do not have to re-enter their information when rejoining these Sites. The use of cookies is standard on the Internet. A browser can usually be adjusted to prevent the reception of cookies, or to provide notification whenever a cookie is sent to you. Even without accepting a cookie, you can still access most of the features offered by TSN Web sites.
TSN will not share your information with other organizations besides its regional software distributors or subsidiaries without your prior approval with the exception of some instances below in Information Collected Directly.
- Information Collected Directly
TSN also collects information that is voluntarily provided by site when a site visitor registers or requests services through the Sites:- Contact Information & Professional Data: Such as name, phone number, email address, education, employment background, references, or other general information about you and your company. TSN will never knowingly barter, trade, or sell access to our database of registered users. The personal information you provide to us when making a request may be made available to TSN’s regional software distributors or an TSN subsidiary for completing your request. After fulfilling your request, the information you provide may be used by us for direct marketing of TSN, its subsidiaries, or regional software distributors, TSN may use the services of a third parties to process your information and send you mailings.
- Billing & Transaction Information: Such as credit card or other financial information required to process your purchases. This information is used solely to process relevant transactions with our payment processor and is kept completely confidential and will be used only to contact you or process transactions. If you choose to save credit card or financial information, it will be stored by PayPal or Authorize.net and should refer to their policies. You may choose to have this information removed at any time.
- Correcting and Changing User Information and Preferences
If you are receiving e-mail communications from TSN but wish to discontinue the service, you may request to do so at any time by filling out a request form on the Contact Us page on any of the Sites. You also have the option to request a revision of your user information at any time in the same manner. - Information Security
TSN understands the need for user privacy, and we maintain strict security procedures to protect your information. TSN has appointed an Administrator to monitor privacy practices.Access to your data is strictly limited to specific individuals who have been trained to respect user privacy. The access given to these employees is confined to their need for such information for business reasons. A log of those who accessed the data is maintained and monitored to prevent security breaches. - What other information should I know about my privacy?
TSN contains links to other web sites. Note: When you click on one of these links, you are entering another web site for which TSN has no responsibility. We encourage you to read the privacy statements of all such sites, as their policies may be materially different from TSN’s policies. You are solely responsible for maintaining the secrecy of your passwords and account information. All Billing & Transaction information you provide to TSN is transmitted using SSL (Secure Socket Layer) encryption. SSL is a proven coding system that lets your browser automatically encrypt, or scramble, data before you send it to us. - Children and Privacy
TSN encourages parents and guardians to be fully familiar with the sites visited by their children. TSN sites will not intentionally contain content that is generally considered unsuitable for children. - Links to Other Sites
TSN web sites may contain links to sites owned and/or operated by other organizations, and the privacy policies of those sites may differ from that of TSN. These sites may collect data and make use of it in ways that TSN does not. We encourage you to review the privacy policies posted on all third-party sites. - Transfer of Information
In accessing TSN Sites, you may be transferring personal data that is used by TSN for statistical, administrative, or marketing purposes. As a worldwide organization, TSN collects data that may be transferred internationally throughout TSN offices worldwide. Quote Terms & Conditions
2. Connections are quoted in full box quantities. A $15 repackaging fee will apply per box for less than full box quantities to cover labor and box.
3. A $50 repackaging fee applies to each less than full pallet quantity of VertiTrack, DriftTrak, & CircleTrak to cover labor and material.
4. Free shipping on full boxes of clips/connectors. This applies to standard ground shipping within the continental United States only; Alaska and Hawaii are not included. Orders with broken boxes are not included. Does not include extra charges for Construction Site, Lift Gate Service, Residential Delivery, Delivery Notification, or Setting Appointments. A freight charge will apply to all orders containing mixed orders with members/clips , VertiTrack, CircleTrak, DriftTrak, Thermafast, any member order over 6 feet, and special clips; please call for freight quote.
5. The terms and conditions of the TSN Master Purchase Agreement for members apply to this quotation in addition to the standard terms and conditions published on TSN’s website (http://www.steelnetwork.com/site/Policies).
6. All structural metal is coated with G60 unless otherwise noted. All stud member knockouts are standard 12″ from leading end, unless otherwise noted. Studs less than 6 ft. will be un-punched and anything less than 5 ft. will incur a cut charge.
7. Freight may be prepaid on full truck load metal orders of 40,000 pounds. Less than truckload shipments may incur freight charges. Maximize savings by quoting full truckload quantities.
8. Freight may be subject to increased transportation surcharges and trucker availability at time of shipment.
9. TSN accepts returns on its standard catalog products under most circumstances. Customers must have TSN authorization prior to acceptance of any returns. All products must be in original boxes and have full count of pieces; opened boxes or containers cannot be returned. Modified or custom-made products, including all products that have to be specifically cut, assembled, or otherwise produced for specific projects or applications, and specifically including all stud, column, and StiffWall SW-S products, may not be returned for any reason other than warranty claims authorized in advance by TSN. Customer must pay return freight to TSN. No products may be returned after 90 days from delivery. A 20% restocking and repackaging fee will be charged. Customer responsible for original and return freight.
10. Due to continuous rising steel costs, TSN will be holding quotes for a maximum of 30 days. In order to protect The Steel Networks customers against raw material price increases TSN recommends that its customers budget a 10% escalator every 30 days from the date of their quote to allow for inflation, supply/demand spikes, and other price disrupting events that are difficult to anticipate.

Shipping
Returns
TSN accepts returns on its standard catalog products under most circumstances. Customers must have TSN authorization prior to acceptance of any returns. All products must be in original boxes and have full count of pieces; opened boxes or containers cannot be returned. Modified or custom-made products, including all products that have to be specifically cut, assembled, or otherwise produced for specific projects or applications, and specifically including all stud, column, and StiffWall SW-S products, may not be returned for any reason other than warranty claims authorized in advance by TSN. Customer must pay return freight to TSN. No products may be returned after 90 days from delivery. A 20% restocking and repackaging fee will be charged. Customer responsible for original and return freight.
Product Use
Products on this site are designed and manufactured for the specific purposes shown, and should not be used in other applications unless approved by a qualified design professional. All modifications to products or changes in installation procedures should be made by a qualified design professional. The performance of such modified products or altered installation procedures is the sole responsibility of the design professional or installation contractor. The installation contractor and/or qualified design professional are responsible for installing all products in accordance with relevant specifications and building codes.
Customers modifying products or installation procedures, or designing non-standard products for fabrication by TSN shall, regardless of specific instructions to the user, indemnify, defend, and hold TSN harmless for any and all claimed loss or damage occasioned in whole or in part by non-standard or modified products or installation procedures.
Loads published on TSN’s website and current product catalogs site are for the described specific applications of properly installed products. Modifications to TSN products, improper loading or installation procedures, or deviations from recommended applications will affect TSN products’ load-carrying capacities. TSN products are fabricated from hot-dipped galvanized steel for corrosion protection but will corrode and lose load-carrying capacity if exposed to salt air, corrosive fire-retardant chemicals, fertilizers, or other substances that may adversely affect steel or its galvanized coating. This website reflects changes in the allowable loads and configurations of some of TSN’s products. This information supersedes information in earlier catalogs or technical reports. All earlier catalogs or technical reports should be discarded and reference made exclusively to this website. TSN may correct any clerical or typographical errors. All sales are subject to TSN’s standard terms and conditions of sale.
Limited Warranty
TSN warrants its products to be free from defects in material or workmanship at the time of shipment. TSN standard catalog products are warranted for adequacy of design when used in accordance with design limits on this website and properly specified and installed. TSN products shall not be substituted with non-TSN products if it is part of a system. Substitution of a TSN product will immediately void any warranty claim made by Purchaser. This warranty excludes uses not in compliance with specific applications and installation procedures set forth in this catalog. Warranty claims must be made by Purchaser in writing within ninety (90) days of receipt of the Products.
All warranty obligations of TSN shall be limited, at the sole discretion of TSN, to repair or replace the defective product(s). These remedies shall constitute TSN’s sole obligation and sole remedy of purchaser under this warranty. In no event will TSN be responsible for incidental, consequential, indirect, exemplary, incidental, special, consequential, or punitive damages, or other losses or damages however caused, including, but not limited to, installation costs, lost revenue or lost profits. TSN’s liability for damages shall in no event exceed the applicable portion of the purchase price for defective product(s).
Product defects that arise from acts of God, accidents, misuse, misapplication, improper installation, storage damage, negligence, or modification to product(s) or its components are specifically excluded from this warranty. Product defects that arise from Purchaser providing incorrect information to TSN, including but not limited to incorrect specifications such as incorrect dimensions, designs and/or loads, are also specifically excluded from this warranty. TSN does not authorize any person or party to assume or create for it any other obligation or liability in connection with Products except as set forth herein.
This Warranty is expressly in lieu of all other warranties, expressed or implied, including any warranties of merchantability or fitness for a particular purpose, all such other warranties being hereby expressly excluded.
